This Privacy Notice for California Residents supplements the information contained in the Tytan’s Privacy Policy and applies solely to all visitors, users, and customers who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and any terms defined in the CCPA have the same meaning when used in this Notice.

This Notice does not apply to employment-related personal information collected from California-based employees, job applicants, contractors, or similar individuals.

Information We Collect

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device ("personal information"). Personal information does not include:

  • Publicly available information from government records.

  • Deidentified or aggregated consumer information.

  • Information excluded from the CCPA's scope, like:

    • health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data; and

    • personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

The table below displays the categories of personal information we may have collected within the last twelve (12) months, the business purpose for which it was collected, and the categories of third parties to whom we disclosed or shared the information. The list of examples for each category is intended to be illustrative and not exhaustive.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice. Except as outlined in the table above, in the preceding twelve (12) months, Tytan has not knowingly sold any personal information to third parties.

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding the collection, disclosure, or sale of their personal information.  This section describes your CCPA rights and explains how to exercise those rights.

Right to Opt-Out of the Sale of Personal Information

You have the right to request that we do not sell your personal information. To exercise this right,

Right to Know

You have the right to request that we disclose the categories and personal information we collected, used, disclosed, or sold during the past 12 months and the third parties with whom we disclosed or shared your personal information.

We do not provide these access and data portability rights for B2B personal information.

Deletion Request Rights 

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete your personal information from our records, unless an exception applies. Such exceptions include, but are not limited to, scenarios in which your personal information is required in order to complete the transaction for which we collected the information, complying with our legal obligations, or for internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

We do not provide these deletion rights for B2B personal information.

Exercising Right to Know, Right to Opt-Out, and Deletion Rights

To exercise Your Right to Know, Right to Opt-Out and Deletion Rights described above, please submit a verifiable consumer request to us by emailing privacy@tytan.com or mailing your request to Tytan Carrier, Attn: Customer Experience, 

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. Before providing any requested information, we will require you to provide certain information so that we can verify your identity or authority to make the request.

If you are making a consumer request for yourself, ArcBest will require you to provide the following information in order to verify your identity:

  1. First, middle, and last name

  2. Physical California address;

  3. Date of birth (MM/YYYY); and

  4. Email address. 
     

If you are an authorized agent making the request on behalf of a consumer, in addition to the consumer information above, ArcBest will require you provide the following:

  • For agents who are businesses:

    • Certificate of good standing with your state of incorporation;

    • Proof of registration with the California Secretary of State; and

    • Valid email address.

  • For agents who are individuals:

    • Valid power of attorney; and

    • Valid email address.


We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format 

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If we deny your request for any reason, we will provide an explanation in our response to you.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.

  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

  • Provide you a different level or quality of goods or services.

  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
     

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
